Terms and Conditions

Any booking made with ElainsCape Eco-Tours ('the Company') is subject to the following terms and conditions. It is deemed that you have read and understood and agreed to be bound by the terms and conditions as detailed here-under when any contact form is submitted.

1. Cancellations by client:
Any client that wishes to cancel any bookings made with 'The Company' must do so in writing and acknowledgement must be received from our offices. If the tour is cancelled more than 30 days in advance 50% of the deposit is forfeited. If the tour is cancelled in 30 days or less 100% of the deposit is forfeited.

2. Cancellations or alterations by ElainsCape Eco-Tours
The Company reserves the right to change any route or cancel arrangements where necessary (eg. changes in weather conditions or circumstances beyond our control). No compensation will be given for claims relating to inconvenience caused.

3. Jurisdiction
The client undertakes to comply with South African laws and regulations.

4. Indemnity, waiver of liability

ElainsCape Eco-tours, its guides and employees will endeavour to make your tour experience as safe and enjoyable as possible, but accept no responsibility for loss or damage to any personal property. Travel insurance is compulsory and should be arranged prior to departure. Such travel cover should cover you in the event of cancellation or curtailment, death, any medical treatment or rescue required as well as loss or theft of money, luggage or personal effects.

The client acknowledges that the activities of eco-tours could involve inherent risks. ElainsCape Eco-Tours accepts no responsibility for matters arising out of political violence, epidemics, natural-disasters, adverse weather conditions, armed robbery, and any other events that are out of our control. ElainsCape Eco-Tours will be entitiled to retain monies received should a tour be cancelled or abandoned due to such an event.

The client certifies that he/she is medically fit to participate in any of ElainsCape Eco- Tour activities and indemnifies 'the company' against any injury or death that may result from participation in such tours.
